Time limits apply: most claims must be filed within 2 years of when you learned of the injury, and a public hospital may need notice within 90 days.
We trust doctors, nurses and hospitals with our health. Most do excellent work, but when a provider makes a preventable mistake, the harm can be devastating: a worsening illness, another surgery, permanent disability or the loss of a loved one. Medical malpractice happens when a health care provider fails to give the care a reasonably careful provider would have given in the same situation, and that failure causes injury.
These are some of the most complex injury cases there are. They require medical records, expert review and careful preparation, and the providers and their insurers defend them hard. IBEZIM LAW OFFICES, PC represents patients and families across New Jersey. Attorney Sebastian O. Ibezim, Jr. has practiced law in New Jersey since 1997 and in New York since 1999, with nearly 30 years of trial and litigation experience. We listen to your story, review your records with qualified medical experts, and tell you honestly whether you have a case.
Misdiagnosis and delayed diagnosis
Missed or late diagnosis of cancer, heart attack, stroke, infection and other conditions, when earlier treatment could have changed the outcome.
Surgical errors
Wrong-site surgery, damage to nerves or organs, instruments left inside the body and poor post-surgical care.
Medication errors
Wrong drug, wrong dose, dangerous interactions and pharmacy mistakes that cause harmful reactions.
Birth injuries
Preventable injuries to a baby or mother during pregnancy, labor and delivery.
Emergency room errors
Patients sent home too soon, missed warning signs and delays in testing or treatment.
Anesthesia and hospital negligence
Anesthesia mistakes, hospital-acquired infections, falls and failures to monitor patients.
A bad outcome alone isn’t malpractice. To win a case in New Jersey, you generally must show:
| Rule | What it means for you |
|---|---|
| Filing deadline | Most malpractice lawsuits must be filed within 2 years. Under the discovery rule, the clock may start when you learned, or reasonably should have learned, of the injury and its cause. Different deadlines can apply to children. |
| Affidavit of Merit | Soon after the lawsuit is filed, New Jersey requires a sworn statement from a qualified medical professional that the care likely fell below accepted standards. Missing this deadline can end the case. |
| Expert testimony | Malpractice cases almost always need qualified medical experts, usually in the same specialty as the provider, to explain what went wrong. |
| Public hospitals and providers | If the provider is a public entity or employee, a notice of claim is usually due within 90 days, and stricter rules apply. |
| Nonprofit hospitals | Special limits on damages can apply to some claims against nonprofit hospitals, which can affect who should be named in the case. |
Economic damages
Medical bills to correct the harm, future care and therapy, lost wages and reduced earning ability.
Non-economic damages
Pain and suffering, emotional distress, disability, disfigurement and loss of enjoyment of life. Families may also bring wrongful death claims.
Every case is different. The value of a claim depends on the injury, its long-term effects, the evidence and the available insurance coverage.
We also help people hurt in slip and fall accidents, workplace accidents and car accidents.
Not every bad outcome is malpractice. The question is whether the provider failed to meet the accepted standard of care and whether that failure caused your injury. We review your records, often with a medical expert, and tell you honestly what we find.
Most claims must be filed within 2 years of when you discovered, or should have discovered, the injury. Different rules can apply to children and to public hospitals, so don’t wait.
Yes, if a reasonably careful provider would have made the correct diagnosis and the delay or error caused you harm, such as a cancer that spread or a condition that became harder to treat.
Yes. When malpractice causes a death, the family may be able to bring a wrongful death claim and a claim for the pain and losses the person suffered before death.
