Bikes & E-Bikes

Road bikes, commuters, delivery riders and e-bike crashes.

Don’t wait: most claims must be filed within 2 years, and claims involving a public road defect or vehicle may need notice within 90 days.

A cyclist has no seatbelt, no airbag and no steel frame for protection. When a car, truck or bus hits a bicycle, the rider takes the full force of the impact, often suffering serious injuries even at low speeds. And because many drivers assume cyclists don’t belong on the road, injured riders are often blamed for crashes they didn’t cause.

At IBEZIM LAW OFFICES, PC, our New Jersey bicycle accident lawyers protect injured cyclists and their families. Attorney Sebastian O. Ibezim, Jr. has nearly 30 years of trial and litigation experience in New Jersey and New York. We investigate the crash, prove who was at fault, deal with every insurance company involved, and fight for full compensation. The consultation is free, and you pay no attorney’s fee unless we recover compensation for you.

What Causes Bicycle Accidents in New Jersey?

Unsafe passing

Drivers who pass too closely or too fast sideswipe riders or force them off the road. New Jersey’s Safe Passing Law requires drivers to give cyclists room.

Turning drivers

Left turns across a cyclist’s path and “right hooks” at intersections and driveways are among the most common bicycle crashes.

Dooring

A parked driver opens a door into the bike lane or traffic, leaving the rider no time to stop or swerve.

Distracted and impaired drivers

Texting, phone use and drunk driving make it far more likely a driver will never see a cyclist until impact.

Dangerous road conditions

Potholes, broken pavement, debris and poorly designed bike lanes can throw a rider. A town, county or the state may be responsible.

Hit-and-run drivers

When the driver flees, your own auto insurance may still provide coverage. Reporting the crash quickly is critical.

Common Bicycle Accident Injuries

Head and brain injuries

Concussions and traumatic brain injuries can occur even with a helmet, affecting memory, concentration and mood.

Broken bones

Fractured wrists, collarbones, hips and legs are common as riders are thrown onto the pavement or the vehicle.

Spinal, facial and soft-tissue injuries

Back and neck injuries, dental and facial damage, and deep road rash often need surgery and leave lasting scars.

See a doctor right away, even if you feel fine, and follow your treatment plan. Your medical records are the strongest evidence of what the crash did to you.

New Jersey Bicycle Accident Law: What Cyclists Should Know

RuleWhat it means for you
PIP coverageIf a motor vehicle hits you while you’re cycling, your own or a household member’s auto policy usually provides PIP for your medical bills. If you don’t have auto insurance, the PIP from the vehicle that hit you may apply.
Safe Passing LawDrivers must change lanes when they can to pass a cyclist. If they can’t, they must leave at least 4 feet and slow to 25 mph. A driver who breaks this rule can be held responsible for the crash.
Lawsuit thresholdIf your auto policy has the “limitation on lawsuit” option, it may affect your right to sue for pain and suffering, as in a car crash. We’ll check your policy.
Comparative negligenceYou can still recover if you were partly at fault, as long as you were not more than 50% responsible. Your award is reduced by your share of the fault.
DeadlinesMost lawsuits must be filed within 2 years of the crash. If a public road defect or government vehicle was involved, a notice of claim may be due within 90 days.

New Jersey requires riders under 17 to wear a helmet. For adults, not wearing a helmet doesn’t bar your claim, though insurers may argue it made your injuries worse.

How We Help Injured Cyclists

We investigate quickly

We gather the police report, photos, traffic and doorbell video, witness statements and damage to your bike before evidence disappears.

We prove fault

When needed, we work with accident reconstruction professionals to show how the driver caused the crash and to answer claims that you rode unsafely.

We sort out the insurance

PIP, health insurance, the driver’s liability policy and your UM/UIM coverage can all apply. We find every source of coverage and deal with each insurer for you.

We’re ready for court

We prepare every case as if it will go to trial. That preparation strengthens your position when it’s time to negotiate a settlement.

Compensation You May Recover

Economic damages

Medical bills, surgery, rehabilitation, future care, lost wages, reduced earning ability, and repair or replacement of your bike and gear.

Non-economic damages

Pain and suffering, emotional distress, scarring, loss of enjoyment of life, and loss of companionship for a spouse.

If a crash takes a loved one’s life, the family may bring a wrongful death claim for lost financial support, funeral costs and loss of guidance and companionship.

What to Do After a Bicycle Accident

  1. Call 911 and get medical care. Make sure a police report is filed, even if the driver offers to “settle it” privately.
  2. Document the scene. Photograph the vehicle, the road, the bike lane, your bike and your injuries. Get the driver’s license, plate and insurance details, and witness contacts.
  3. Keep your bike, helmet and gear. Don’t repair or throw them away. They are evidence.
  4. Look for video. Note nearby stores, homes with doorbell cameras and traffic cameras, since footage is often erased within days.
  5. Don’t give a recorded statement to the driver’s insurer, and don’t post about the crash on social media.
  6. Call a New Jersey bicycle accident lawyer for a free review of your case.

We also handle pedestrian accidents, motorcycle accidents, car accidents and Uber and Lyft accidents across New Jersey.

Bicycle Accident FAQ

Who pays my medical bills after a bicycle accident in New Jersey?

If a motor vehicle hit you, PIP from your own or a household auto policy usually pays first. If you have no auto policy, the PIP of the vehicle that hit you may apply. We then pursue the at-fault driver for your other losses.

Can I recover if I wasn’t wearing a helmet?

Usually, yes. For adults, not wearing a helmet doesn’t defeat a claim if the driver caused the crash, though it may be argued it affected your injuries.

Does this apply to e-bike accidents?

Yes, we handle e-bike crashes too. Coverage for e-bikes can be more complicated than for regular bicycles, so it’s important to have every policy reviewed.

What if the driver left the scene?

Report the crash to police right away. Your own auto policy’s uninsured motorist (UM) coverage may pay for your injuries even if the driver is never found.

How much does a bicycle accident lawyer cost?

The consultation is free, and you pay no attorney’s fee unless we recover compensation for you. We explain the fee agreement, including case costs, before you sign anything.
