Don’t wait: most claims must be filed within 2 years, and a fall on public property may need a notice of claim within 90 days.
Property owners in New Jersey have a duty to keep their premises reasonably safe. Stores, restaurants, landlords, office buildings, parking lot owners and other businesses must fix hazards they know about, or should have found through reasonable inspection, and warn visitors about dangers they haven’t fixed yet. When they don’t, and someone gets hurt, the law calls it premises liability.
IBEZIM LAW OFFICES, PC helps people injured in slip, trip and fall accidents across New Jersey. Attorney Sebastian O. Ibezim, Jr. has practiced law in New Jersey since 1997 and in New York since 1999, with nearly 30 years of trial and litigation experience. The consultation is free, and you pay no attorney’s fee unless we recover compensation for you.
Wet or slippery floors
Spills, freshly mopped floors, leaking coolers and tracked-in rain at stores, restaurants and building lobbies, often with no warning sign.
Snow and ice
Uncleared sidewalks, parking lots, steps and building entrances, and ice from poor drainage or melting and refreezing.
Broken stairs and railings
Loose or uneven steps, missing handrails and worn treads in apartment buildings, homes and commercial properties.
Uneven sidewalks and parking lots
Cracked pavement, potholes, raised slabs and broken curbs outside businesses and in shopping center lots.
Poor lighting
Dark stairwells, hallways and parking areas that hide hazards and make a trip or fall far more likely.
Clutter and loose mats
Boxes in store aisles, cords across walkways, torn carpet and bunched-up floor mats that catch your foot.
Falls can happen almost anywhere: supermarkets, retail stores, restaurants, apartment buildings, office buildings, hotels, gyms, construction sites and public sidewalks.
See a doctor the same day if you can, even if you feel fine. A gap in treatment is one of the first things insurance companies use against your claim.
| Rule | What it means for you |
|---|---|
| Duty of care | A business owes its customers and other invited visitors reasonable care, including inspecting for hazards and fixing or warning about them. The duty owed to social guests and trespassers is more limited. |
| Notice of the hazard | You usually need to show the owner knew about the hazard, or should have found it in time to fix it. In some self-service stores, the law may not require proof of notice for hazards that come from the way the business operates. |
| Sidewalks | Commercial property owners in New Jersey generally must keep the public sidewalk next to their property in reasonably safe condition. Owners of homes generally do not have the same duty. |
| Comparative negligence | You can still recover if you were partly at fault, as long as you were not more than 50% responsible. Your award is reduced by your share of the fault. |
| Deadlines | Most injury lawsuits must be filed within 2 years. If you fell on property owned by a town, county, state agency, school or NJ Transit, a notice of claim is usually due within 90 days, and stricter rules apply. |
Falls on snow and ice: In general, New Jersey commercial property owners don’t have to clear snow and ice while a storm is still going on, but they must act within a reasonable time after it ends. There are exceptions, for example when the owner made the conditions worse. These cases depend on timing, so weather records and photos matter.
Economic damages
Medical bills, future treatment and therapy, lost wages and reduced earning ability. Unlike a car accident, there is no PIP coverage, so these losses are part of your claim against the property owner.
Non-economic damages
Pain and suffering, emotional distress, scarring, loss of enjoyment of life, and loss of companionship for a spouse.
Every case is different. The value of your claim depends on your injuries, your treatment, the available insurance coverage and the evidence of what caused your fall.
We also help people hurt in workplace accidents, medical malpractice, pedestrian accidents and car accidents.
Often, yes. If the store knew about the spill or hazard, or should have found it in time, it may be responsible. In self-service stores, hazards that come from how the store operates can be easier to prove. Report the fall and ask for the incident report.
It depends on who owns the property. Commercial property owners generally must keep the abutting sidewalk reasonably safe and clear snow and ice within a reasonable time after a storm. Homeowners generally don’t have the same duty, and falls on public property follow special rules.
Often, yes. Landlords must keep common areas such as stairs, hallways, lobbies and parking lots reasonably safe, and repair hazards they know about. Report the problem in writing and keep copies.
Most injury lawsuits must be filed within 2 years. If public property was involved, a notice of claim is usually due within 90 days, so call as soon as you can.
