Nearly 30 years of trial experience in New Jersey and New York.
We help riders, rideshare drivers, other motorists, pedestrians and cyclists.
Save the trip details: screenshot your ride receipt and the app’s trip record now. They can be key evidence.
Uber and Lyft are part of everyday life in New Jersey, from airport trips to nights out in Hoboken and commutes into New York City. But when a rideshare trip ends in a crash, the claim is more complicated than an ordinary car accident. Which insurance pays depends on what the driver was doing in the app at the moment of the crash, and rideshare companies have large legal teams protecting their interests.
At IBEZIM LAW OFFICES, PC, our New Jersey rideshare accident lawyers know how these claims work. Attorney Sebastian O. Ibezim, Jr. has nearly 30 years of trial and litigation experience in New Jersey and New York. We secure the trip data, identify every insurance policy, and fight for full compensation. The consultation is free, and you pay no attorney’s fee unless we recover compensation for you.
Uber and Lyft passengers
If you were injured as a passenger, you weren’t at fault. You may have claims against the rideshare driver, another driver, or both.
Rideshare drivers
If another driver hit you while you were driving for Uber or Lyft, you may have claims against that driver and coverage through the rideshare company’s policy.
Other drivers and passengers
If a rideshare driver caused a crash with your vehicle, the rideshare driver’s personal policy or the company’s policy may apply, depending on the app status.
Pedestrians and cyclists
Rideshare drivers watching their phones or stopping suddenly for pickups can hit people on foot or on bikes.
New Jersey law sets minimum insurance for rideshare (transportation network company) drivers based on what the driver was doing at the time:
| Driver’s app status | Coverage that usually applies |
|---|---|
| App off | The driver’s personal auto insurance, the same as any other driver. |
| App on, waiting for a ride request | Primary liability coverage of at least $50,000 per person and $100,000 per incident for bodily injury, plus $25,000 for property damage. |
| Ride accepted or passenger on board | Primary liability coverage of at least $1,500,000 for death, bodily injury and property damage. |
Your own auto policy, including PIP and uninsured/underinsured motorist (UM/UIM) coverage, may also play a role. Insurers often dispute the driver’s app status, so we move quickly to obtain the trip records that settle it.
Distracted driving
Rideshare drivers constantly check the app for requests, directions and ratings, taking their eyes off the road.
Sudden stops and pickups
Drivers stop or swerve without warning to pick up or drop off riders, often in traffic lanes or near intersections.
Fatigue
Many drivers work long hours or drive after another job, which slows reaction time.
Unfamiliar routes
Following GPS on unfamiliar roads leads to sudden lane changes, missed turns and wrong-way driving.
Speeding to the next fare
Pressure to complete more trips can push drivers to speed and run lights.
Other negligent drivers
Many rideshare crashes are caused by another motorist, which can mean several insurers are involved.
We secure the trip data
We request the app records showing the driver’s status, route and timing, along with police reports, photos and video, before evidence is lost.
We identify every policy
The driver’s personal insurance, the rideshare company’s policy, the other driver’s coverage and your own PIP and UM/UIM can all apply. We pursue each one.
We deal with the insurers
Rideshare companies and their insurers often shift blame to each other. We handle all communication so you can focus on recovery.
We’re ready for court
We prepare every case as if it will go to trial. That preparation strengthens your position when it’s time to negotiate.
Economic damages
Medical bills beyond PIP, future treatment, lost wages, reduced earning ability, and vehicle repair or replacement.
Non-economic damages
Pain and suffering, emotional distress, scarring, loss of enjoyment of life, and loss of companionship for a spouse.
New Jersey’s usual rules still apply: comparative negligence (you can recover if you were not more than 50% at fault), the lawsuit threshold on many auto policies, and a 2-year deadline for most lawsuits.
We also handle car accidents, truck accidents, pedestrian accidents and bicycle accidents across New Jersey.
Rideshare drivers are usually treated as independent contractors, so claims typically go through the insurance the company is required to carry, plus the drivers involved. We review the facts to identify every party and policy that may be responsible.
It depends on who caused the crash and the driver’s app status. With a passenger on board, the rideshare company’s policy of at least $1.5 million in liability coverage usually applies. Your own auto policy may also provide benefits.
You may have a claim against the at-fault driver, plus coverage through the rideshare company’s policy depending on your app status. If you were working, other benefits may also apply. We’ll review your situation.
Most lawsuits must be filed within 2 years of the crash. Trip data and video can disappear much sooner, so call as soon as you can.
The consultation is free, and you pay no attorney’s fee unless we recover compensation for you. We explain the fee agreement, including case costs, before you sign anything.
